On May 26, he filed a motion in the district court, asking the court to quash the criminal complaint, arrest warrant, and information, and to discharge him. The motion was predicated on the ground that the warrant was issued in violation of the provisions of Art. II, Â§ 10, Constitution of New Mexico, and Â§ 41-1-2, N.M.S.A. 1953 (Repl. Vol. 6). Because of the asserted violations, defendant claimed he was entitled to be discharged under Â§ 41-1-3, N.M.S.A. 1953 (Repl. Vol. 6). The court denied the motion.
