The opinion of the court was delivered by This is a criminal action wherein the defendant was charged
with the first degree murder of his wife pursuant to K.S.A.
21-401. He was convicted by a jury of second degree murder
pursuant to K.S.A. 21-402 and was sentenced in accordance with
K.S.A. 21-403 and K.S.A. 76-2306 to the Kansas State Industrial
Reformatory for a term of twenty years. Appeal has been duly
perfected. The appellant contends the trial court erred in three
particulars: (1) In allowing the appellant's confession to police
officers to go to the jury; (2) in failing to give an instruction
on insanity; and (3) in permitting certain rebuttal testimony to
go to the jury.
